Faulty tourist service
Setting off on a journey no one expects that something may go not as it was concluded in the agreement with the travel agency. We have to be aware of the fact that not everyone on the Polish tourist market provides services with standards included in the agreement.
Faulty performance of a tourist sevice, meaning inadequate fulfillment of contract conditions, brings the organizer to the compensative responsibility. It is also associated with services not performed directly by the organizer but by the third party, e.g. flight or transport, connected with the realization of the deal.
The list of the most frequent consument problems resulting from a faulty fulfillment of contract conditions includes:
- Lower hotel standard,
- Less attractive location, e.g. too far from the centre or from the beach,
- Lack of additional trips,
- Lack of adequate room fitting,
- Lack of adequate board,
- Shorter time of the tourist event,
- Lack of transfer,
- Lack of expected procedures
We have to be fully aware of the fact that the travel agency is responsible for the negligences of its subcontractors. Therefore, it cannot order the consument to claim for the refund to these entities. It is not possible to exlcude or limit the responsibility of the travel agency, unless it has been stipulated in the contract and the organizer’s responsibility is limited to a double multiplicity of the tourist’s event price to every client- it does not concern damage on a person. It is crucial to mention that the organizer does not bear the responsibility only when the inadequate service, or lack of service, is caused by:
- Client’s actions or abandonment.
- The abandonmnet of the third party, not taking part in the peformance of services included in the contract, if these actions or abandonment could not be expected or avoided.
- Force majure- e.g. flood, earthquake.
